Kellar, 40, of Mason City, rear-ended a car that had stopped to turn near 15th Street Southeast and South Pennsylvania Avenue about 11 p.m. Friday, Sept. 28, according to police.
Police said his passenger, Shawn True, 36, of Mason City, was killed in the crash. Kellar was treated and released from Mercy Medical Center--North Iowa, a hospital spokeswoman confirmed.
Earlier this week, police said criminal charges are pending but said they could not comment further due to ongoing investigation.
“Once we have all of the reports completed and reports that we need from others, we’ll make a final conclusion,” Mason City Police Chief Jeff Brinkley said Monday.
No criminal charges had been filed as of Wednesday morning.
