A rural Garner man who pleaded guilty to having sex with a 14-year-old girl in a Pammel Park bathroom in Forest City in October has been given probation.

Zakary Tyler Schachtner, 19, was granted a deferred judgment this week in Winnebago County District Court on a felony charge of third-degree sexual abuse.

Court documents say he was charged with that offense because he performed a sex act with someone four or more years younger than him.

He was ordered to serve three years of probation and stay at a residential treatment facility for up to 180 days.

If he successfully completes probation, an entry of judgement will not be made and the record of his deferred judgement will be expunged.

However, he will remain under lifetime supervision by the Iowa Department of Corrections unless he is granted parole. 

Schactner also must register as a sex offender.

He was ordered to pay a $250 civil penalty as well as a $100 sexual abuse surcharge.

The state agreed to base its recommendation  for sentencing on the outcome of a pre-sentence investigation in the case, according to Schachtner's written guilty plea filed in May. 

The maximum sentence for third-degree sexual abuse is up to 10 years in prison.
