Notice is hereby given that ITC Midwest LLC (ITC Midwest) (Petitioner), with its principal place of business
at 123 5th Street SE, Cedar Rapids, Iowa, 52401, proposes to rebuild an existing 161kV transmission line in
Cerro Gordo County, Iowa. The proposed line is a request to bring a transmission source into a new distribution
substation being built. It will be a substation interconnection that has been requested by the distribution company
to serve greater load. The notification corridor and the proposed line route for which new easements may be
sought in Cerro Gordo county are reflected on the enclosed map and by reference made a part hereof. The
notification corridor is the area in which landowners and tenants are noticed concerning the public information
meeting and in which easements may be sought after the meeting is held.
Prior to construction of this transmission line, the Petitioner must request a franchise from the Iowa Utilities
Board (Utilities Board) authorizing the construction, operation and maintenance of the transmission line along
the proposed route. The proposed route of the two lines begin at the Mason City corporate limits, just north of US
Highway 18 and travel south where the line ends just north of 230th street. Another portion of the line is east of
the previously described line and it too starts just outside the Mason City corporate limits, north of US Highway
18, where it travels south and turns easterly just south of US Highway 18. This portion of the line continues to
travel southeasterly until it reaches US Highway 65. It travels south along the westside of US Highway 65 and
stops just north of 230th street. The lines total a distance of approximately1.20 miles. The final route may change
and will be determined when easement negotiations with landowners are complete and the Iowa Utilities Board
has approved the project.
ITC Midwest may seek to acquire easements within the identified corridor for the construction, operation and
maintenance of the line described in this notice. Any easement request will also include the right to maintain the
right-of-way so as not to interfere with the construction, operation or maintenance of the transmission line and the
right of ingress and egress to the easement area. After the Utilities Board has reviewed the petition for franchise
it may conduct a public hearing and landowners would have a right to participate in the hearing process. If a
hearing is conducted, notice of the public hearing will be published in a Cerro Gordo County newspaper with
county wide circulation. There is the possibility that right-of-way may be acquired by condemnation if approved
by the Utilities Board. At this time, the Petitioner has not requested and does not have the right of eminent
domain in order to acquire the property rights by condemnation. If eminent domain is requested by the Petitioner,
a hearing must be conducted by the Utilities Board where the request will be considered, and the Petitioner must
show that the property rights are needed to serve a public use. If the Petitioner requests the right of eminent
domain, a notice of the public hearing will be sent to the owners of record and parties in possession of the
parcels subject to the request for eminent domain by return receipt mail in addition to the notice being published
Cerro Gordo county newspaper with county wide circulation.
As a landowner or a party adjacent to, in possession of, or residing on property which may be affected by the
location and construction of the aforementioned electric transmission line, you have the right to be present
at an Informational Meeting to be held at the place and time listed below. You also have the right to file with
the Utilities Board objections to the location and construction of the proposed line as described. The Utilities
Board’s address is 1375 E. Court Ave., Room 69, Des Moines, Iowa 50319-0069.
Representatives of the Utilities Board will preside at the Informational Meeting and present a summary of the
legal rights of affected landowners. Qualified representatives of ITC Midwest will be present to discuss the
project and to answer questions. Persons with disabilities requiring assistive services or devices to observe or
participate should contact the Utilities Board at (515) 725-7300 in advance of the scheduled date to request that
appropriate arrangements be made.
