MASON CITY — A Mason City man convicted of kidnapping has appealed the dismissal of his application for post-conviction relief.
Michael Jon Winters, 59, was sentenced to 25 years in prison on a second-degree kidnapping charge in March 2011. He was accused of taking a woman from her home without her consent in June 2010 and holding her for a time. He also displayed a weapon during the incident.
At issue is Winters’ attempt to withdraw his guilty plea which was refused since it was part of his plea agreement.
Judge Colleen Weiland rejected Winters’ second application for post-conviction relief in May, stating his guilty plea was voluntary and that his claims that the plea was involuntary and that counsel was ineffective had already been ruled upon.
His first application was also dismissed.
Winters filed the latest notice of appeal on June 3.
