MASON CITY — A Mason City man serving time in the death of his girlfriend’s 2-year-old son will be in Cerro Gordo County District Court on June 27 for a post-conviction relief hearing.

Christopher McCoy, 39, was convicted by a jury of involuntary manslaughter and child endangerment causing the January 2006 death of Riley Prazak.

In his petition for post-conviction relief, McCoy claimed his trial attorney erred in not requesting a change of venue and in not objecting to the state’s attack on his character during the trial.

McCoy was sentenced in September 2007 to 50 years in prison on the charge of child endangerment resulting in death and five years on the involuntary manslaughter charge. The sentences are being served consecutively.

McCoy was taking care of the child on Jan. 10, 2006, while the boy’s mother, Mindy Prazak, was at work. McCoy claimed he was sleeping when the boy fell from a bed. He called Prazak and emergency responders.

The boy was taken to Mercy Medical Center-North Iowa and then transferred to St. Marys Hospital in Rochester, Minn., where he died three days later.

    One thing I don't understand about this whole case...isn't someone suppose to be proven guilty beyond a reasonable doubt? That was obviously not a requirement in this case otherwise this man would be free. Where does the responsibilty of the mother come into play? Instead she collects restitution. She even went to court to have the checks changed because she wasn't able to cash them because they were made out to both parents.
