MASON CITY | A Mason City man has been charged with attempting to sexually assault a woman.
Marlin Kenneth Nagel, 59, is charged with felony assault with intent to commit sexual abuse causing bodily injury. In Iowa law, rape and sexual assault are charged as "sexual abuse."
Nagel grabbed the woman by her arm and attempted to push her down on a couch at a residence in the 400 block of Second Street Northwest in Mason City on Saturday, court documents said. The exact time of the incident is unknown.
He is accused of exposing himself and telling the victim "you want some," charging documents said.
According to court documents, the woman had bruising on her arm and leg from where Nagel grabbed her.
Nagel was arrested at the intersection of Second Street Southwest and South Jefferson about 4:08 p.m. Sunday for the assault charge.
During search, a Mason City Police officer allegedly found a small clear bag of marijuana and a metallic pipe used to smoke marijuana in Nagel’s front left jean pocket.
Court documents said that Nagel admitted to the officer at the scene that the marijuana and the pipe were both his.
He was charged with misdemeanor possession of a controlled substance, cannabidiol - third or subsequent offense and possession of drug paraphernalia.
Nagel is held in Cerro Gordo County Jail on a $6,300 bond. No court date has been set as of Monday morning.
Nagel has previously been charged with domestic abuse in Cerro Gordo County.
He served two days in jail after being charged with domestic abuse assault in 1994.
Nagel was charged with two counts of domestic abuse assault with intent or displaying a weapon in 2006.
He pleaded guilty to one charge. The other was dismissed.
Nagel was sentenced to 365 days in jail, with 358 days suspended. In total, he had to serve a mandatory sentence of seven days in jail with one year of probation.
