BUFFALO CENTER | A Fort Dodge man has been sentenced to 30 days in jail after one charge was reduced and two others dismissed in a Buffalo Center child abduction case.

Daniel L. Smith, 30, originally charged with felony second-degree burglary, pleaded guilty last week to a misdemeanor charge of trespassing. 

Additional felony charges of child endangerment and assault while participating in a felony were dismissed.

Winnebago County Attorney Adam Sauer stated in court documents that evidence was insufficient to prove the burglary, child endangerment and assault charges against Smith.

Authorities say Ashley Machain, 29, the children’s biological mother, brandished a knife when she and Smith, her alleged accomplice, took two small children from a house in Buffalo Center the afternoon of Nov. 23.

The children, ages 3 and 1, were recovered safely in Fort Dodge shortly before 2:30 a.m. on Nov. 24.

Machain is scheduled to be tried Nov. 1 on felony charges of second-degree burglary, child endangerment and assault while participating in a felony.

The 30-day jail sentence Smith received for trespassing is to be served concurrently with another 30-day sentence he received after pleading guilty to misdemeanor driving while barred.
