MASON CITY | A lawsuit and counterclaim lawsuit over a roofing project involving the Harbourage Owners Association in Clear Lake have been dismissed.
According to court documents, Hansel Construction Services, Parkersburg, has dismissed its lawsuit again Harbourage and Douglas Williams with prejudice. Harbourage also dismissed its counterclaim lawsuit against James Hansel with prejudice.
With prejudice means it can't file another case against the defendant based on the same claims.
According to court documents, Hansel Construction Services and Harbourage entered into a contract on June 22, 2012, to re-roof Harbourage's properties at a cost of $707,567.
Hansel Construction alleged Harbourage failed to fulfill the provisions of the contract and prevented Hansel Construction from fulfilling its obligations under the contract.
Hansel Construction claimed it incurred expenses and sustained injuries, losses and damages including a loss of profits, business, time, material and labor, and damages to its reputation and credit.
Harbourage filed a counterclaim lawsuit against James Hansel in June 2013 in Cerro Gordo County District Court.
